Child Support Modification Motion

A Child Support Modification Motion is a legal request to change a current child support order due to a significant change in circumstances, such as a change in income, custody, or the child’s needs. The motion asks the court to increase, decrease, or end support based on the new situation.

Prisoners should apply immediately upon incarceration or as soon as possible due to the fact that arrears acquire while incarcerated.

County, State & Federal Detainers

A detainer is a legal hold placed on someone in custody, requesting that they be transferred to another jurisdiction for unresolved legal issues.

  • County Detainer: From another county for local charges.

  • State Detainer: From another part of the same state.

  • Federal Detainer: From a federal agency for federal charges or actions (like deportation).

Detainers ensure a person stays in custody until all legal matters are handled.

Clemency

Clemency is an act of mercy by a governor or the president that reduces or forgives a person's criminal punishment. It can include a pardon, commutation (reduced sentence), or reprieve (delay of punishment).

Compassionate Release

Compassionate release is the early release of a prison inmate due to serious health issues, advanced age, or other extraordinary circumstances. It's granted when continued imprisonment is no longer seen as necessary or humane.

Sentence Modification (3582) Motion

Sentence modification under 18 U.S.C. § 3582 allows a federal inmate to request a reduced sentence. It’s often used for compassionate release due to serious medical conditions or changes in the law that lower sentencing guidelines. The court reviews the request and decides if a reduction is justified.

2241 Motion

A 2241 motion refers to a petition filed under 28 U.S.C. § 2241, used by federal prisoners to challenge the conditions of their confinement or the execution of their sentence (like parole, good time credits, or wrongful detention), not the conviction itself. It's filed in the district where the prisoner is held.

2255 Motion

A 2255 motion, under 28 U.S.C. § 2255, is filed by a federal prisoner to challenge their conviction or sentence, usually claiming it was unconstitutional, the court lacked jurisdiction, or their lawyer was ineffective. It must be filed in the court that imposed the sentence.

Writ of Mandamus Motion

A writ of mandamus motion is an extraordinary Court order asking a higher Court to require a lower court, judge, clerk or public official to perform a duty required by law.  It is used generally when there has been an unreasonable delay, refusal to act, or failure to perform a required legal duty.

Motion to Compel or Motion to Expedite

A motion to compel asks a court to require another party, official, clerk, agency, or court participant to take a specification.  A motion to expedite asks the Court to move a matter faster because delay is causing harm or prejudice.

We provide motion preparation and reentry support for incarcerated people and returning citizens. The fees and payment terms below apply to the listed services.
